JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-07-2015 Petitioner is languishing in custody since 06.05.2015 in a case registered for the offences punishable under Sections 370, 370(1), 372, 373, 419, 353, 427, 224, 109 of the Indian Penal Code and Sections 6 & 8 of the Protection of Children From Sexual Offences Act, Sections 3, 4, 5, 7, 8 of the Immoral Traffic(Protection) Act.

The prosecution case is that one Reena Devi aged about 22 years and Sumitra Kumari aged about 20 years were recovered in objectionable condition in the house of the petitioner.

It is submitted by learned counsel for the petitioner that since both the victims were found to be major hence there is no application of Section 6 & 8 of the Protection of Children From Sexual Offences Act. Moreover the petitioner was not present in the house and only on suspicion the

Considering the fact that investigation has already concluded, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-I, Jehanabad in connection with Arwal P.S. Case No. 144 of 2014.
