The petitioner is languishing in custody since 14.11.2015 in connection with Gopalganj Town P.S. Case No.456 of 2015 for the offences instituted under Sections 364 (A), 363 and 120 (B) of the Indian Penal Code.
The prosecution case, in brief, is that the informant filed a written petition before the Station House Officer, Gopalganj Town Police Station on 11.11.2015 stating that his father, who resides in Mumbai for business purpose, informed that Ritesh was kidnapped along with the vehicle. During the search, it came to know that Kuchaikote Police recovered an unclaimed Scorpio vehicle near Sasa Musa Bridge. Therefore, it is suspected that the
Patna High Court Cr.Misc. No.19091 of 2016 (3) dt.26-05-2016 brother of the informant has been kidnapped by unknown criminals for ransom or some other reason.
It is submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 14.11.2015 and the charge sheet has been submitted in the present case. The petitioner is not named in the first information report nor he has been named in the statement of the informant recorded under Section 164 of the Cr.P.C. The other coaccused has been granted bail by order dated 18.04.2016 of this Court passed in Cr. Misc. No.15261 of 2016.
On behalf of the State, it is submitted that the petitioner is not named in the first information report. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Additional Sessions JudgeVIII, Gopalganj in connection with Sessions Trial No.161 of 2016, arising out of Gopalganj Town P.S.
