2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 126 ( 2 ), 115 ( 2 ), 117 ( 2 ), 118 ( 2 ), 109, 118 (1) , 303 ( 2 ), 351 ( 2 ), 4

(3) , 352 and 3 (5) of BNS.

3 . As per F.I.R., on 21.09.2025 , all the named accused persons including these petitioners assaulted nephew of informant, as a result of which he sustained injuries. It is further alleged that accused persons took away gold tabiz from his neck

Patna High Court CR. MISC. No.5423 of 2026(2) dt.03-02-2026 2/2 and also threatened with dire consequences.

4. It is submitted on behalf of the petitioners that allegation of assault is general and omnibus against these petitioners. As per F.I.R. total 4 persons are alleged to have assaulted nephew of informant but there are only 2 injuries. Rest of the allegations are ornamental in nature to make the case grave . Petitioners claim clean antecedent.

5 . Learned counsel for the State oppose the bail petition .

6 Considering the aforesaid facts, clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J M 1st Nawada in connection with Parnadabar P.S. Case No. 248 of 2025 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
