JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 17-05-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Paroo P.S. Case No. 441 of 2022, registered for offence punishable under sections 399, 400, 402 of the Indian Penal Code and 25 (1-b)a, 26, 35 of the Arms Act.

The specific allegation against the petitioner is that one live cartridge and two empty cartridges were recovered from his possession.

The learned counsel for the petitioner has submitted that the petitioner is innocent, he is under custody since 14.09.2022 and on similar footing, co-accused Dhiraj Kumar has been granted bail by a coordinate Bench of this Court in Cr.

Patna High Court CR. MISC. No.13359 of 2023(2) dt.17-05-2023 2/2 Misc. No. 5212 of 2023.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Muzaffarpur West in connection with Paroo P.S. Case No. 441 of 2022, subject to the following condition:- "Before accepting the bail bond, the criminal antecedent of the petitioner shall be verified and if it is found that he is involved in any other cases except the present one and the cases mentioned in paragraph no. 3 of the bail petition, his bail bond shall not be accepted."
