Petitioner is accused in connection with Kumarkhand P.S. Case No. 09 of 2016 registered under Sections 399/402 of the I.P.C. and 25(1-b)A/26/35 of the Arms Act. The accusation is that petitioner was apprehended along with Md. Molim and Md. Jasim by the Police and on search, petitioner was found in possession of one country made loaded pistol, two cartridges and one mobile set.

Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case. It is also submitted that petitioner has no criminal antecedent and is in custody since 24.01.2016.
