JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 20-02-2019 Learned counsel for the petitioner submits that the petitioner is looking for consideration of his name for grant of license of Public Distribution Shop on compassionate ground. It is submitted that vide Annexure-5 dated 08.04.2017 petitioner has made his application to the Sub-Divisional Officer, East, Muzaffarpur but the same is still under consideration and no decision is being taken thereon.

Petitioner has relied on an order of this court passed in CWJC No. 766/2018 wherein under similar circumstances learned co-ordinate Bench of this court has granted liberty to the petitioner to file representation before the Sub-Divisional Officer, East, Muzaffarpur for redressal of her grievance and

In the present facts and circumstances of the case, learned counsel for the State submits that the Sub-Divisional Officer, East, Muzaffarpur may be directed to consider the matter in accordance with law and take a decision thereon within a reasonable time.

This writ application is thus disposed of with a direction to the Sub-Divisional Officer, East, Muzaffarpur to consider the request of the petitioner in accordance with law and guidelines on the subject and take a decision thereon within a period of 90 days from the date of receipt/production of a copy of this order.

This writ application stands disposed of accordingly. Respondent no. 3 shall either decide or place it before the competent authority for taking a decision within a period of 90 days.
