In the present case, the petitioner is seeking anticipatory bail in connection with Laheria Sarai P.S. Case No. 389 of 2019 registered for offence under sections 272, 273 of the Indian Penal Code and section 30 (a) of the Bihar Prohibition and Excise Act A huge quantity of liquor has been recovered from a pick-up van.
Learned counsel for the petitioner submits that the petitioner is owner of the said pick-up van and there is an agreement between the present petitioner and Mukesh Kumar. Mukesh Kumar is driver and he was running the said vehicle at
Patna High Court CR. MISC. No.3980 of 2020(5) dt.10-12-2020 2/2 the rate prescribed therein. He further submits that the petitioner has no connection with the said liquor.
Looking to the quantity of liquor, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for grant of anticipatory bail is rejected. However, if the petitioner surrenders before the court below and prays for regular bail, the court below without being prejudiced by this order will take decision in accordance with law.
