Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 364, 365/34 of the Indian Penal Code.
Suspicion is that the petitioner and others kidnapped to Mantu Sahni and Pramod Sahni. Both the victims are still missing. The report of the Superintendent of Police Muzaffarpur dated 04.05.2019 reveals that the aforesaid persons have not been recovered nor their dead body have been found. Petitioner is in custody since 10.12.2018.
Considering the aforesaid facts, let the petitioner, above named, be released on bail after framing of the charges on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the
Patna High Court CR. MISC. No.5624 of 2019(6) dt.08-05-2019 2/2 satisfaction of learned Court below where the case is pending in connection with Sahebganj Police Station Case No. 311 of 2018, with the following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Rajan/- U T
