This application for anticipatory bail arises out of Lakhisarai (Kabaiya) P.S. Case No. 543 of 2021 for the offence punishable under Sections 30(a)/32(iii) of the Bihar Prohibition & Excise Act.
Considering the fact that the petitioner is the owner of the commercial vehicle in question and he has no direct role in smuggling of the liquor, inasmuch as, he has no criminal antecedent, this bail application is allowed. Let the petitioner, above named, in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs.
Patna High Court CR. MISC. No.6693 of 2022(2) dt.07-03-2022 2/2 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge - II- cum-Special Judge (Excise), Lakhisarai, in connection with Lakhisarai (Kabaiya) P.S. Case No. 543 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
