JUSTICE SUDHIR SINGH ORAL ORDER 28-07-2015 Heard the learned counsel for the petitioner as well as the learned for the State.

The petitioner seeks bail in a case for the offences punishable under sections 313 and 307 of the I.P.C and section 27 of the Arms Act.

The prosecution story, in brief, is that sister of the informant was pregnant and she is living at his house since a month. It is alleged that three days ago a motor machine was stolen away. It is further alleged that in the morning of 27.5.2014 the informant sitting on his darwaja and his sister was going to a Doctor with her mother when the petitioner fired on his sister who sustained injury on her right side of knee.

On behalf of the petitioner it has been submitted that

Patna High Court Cr.Misc. No.26784 of 2015 (2) dt.28-07-2015 2/2 the petitioner is in custody since 15.5.2015. Charge sheet has been submitted in the case. The petitioner has got no criminal antecedent. It is a case and counter case. Counter case is Annexure-2 to the present application.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

In the facts and circumstances as stated above, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Araria in Bhargama P.S. Case No. 60 of 2014.
