Petitioner seeks bail in a case registered under section 302 and other allied sections of the Indian Penal Code as well as section 27 of the Arms Act.

Cross-firing was going on between the petitioner, his son and one Rajesh Kumar @ Are Yadav and the deceased sustained firearm injury by the firing made by FIR named accused Rajesh Kumar @ Are Yadav.

No overt-act has been attributed against the petitioner who is languishing in jail custody since 22.1.2016 and does not have any criminal antecedent.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri D. Kumar, Judicial Magistrate, Ist Class, Barh in Mokama P.S. Case no. 16/2016. shahid (Hemant Kumar Srivastava,J) U T
