The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code to which section 302 of the Indian Penal Code was added subsequently. As per allegation in the F.I.R., the accused persons including the petitioner herein are stated to have come variously armed. On the orders of Satya Prakash Verma, son of the informant Prabhat Kumar Srivastava was assaulted by Amitesh Kumar, Ajay Raj was assaulted by the petitioner and Hitesh Kumar was assaulted by the informant. Subsequently, the informant's son Prabhat Kumar Srivastava died. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.15765 of 2021(3) dt.02-09-2021 2/2 that the petitioner has been falsely implicated in the case. He has not committed any offence. Although the allegation against the petitioner is of having assaulted Ajay Raj, no injury report of Ajay Raj is available in the case diary, the petitioner is in custody since 6.9.2020 and investigation in the case has concluded.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the period in custody, the Court directs the petitioner to be enlarged on bail in connection with Basantpur. P.S. Case no.96 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-VIII, Siwan.
