The petitioners are in custody in a case registered under Sections 366(A), 372 and 373/34 of the Indian Penal Code. The Informant has alleged that she belong to Mahadalit and 4-5 days before one Dinesh Sada came to her house and proposed for marriage with a boy of Arar on which she disclosed that her daughter is minor. He persuaded her and she got ready. On 9.2.2015 he came with a boy and marriage took place in the night. In the morning she noticed the language of the bride groom and came to know that he belongs to U.P. The person with him (petitioner no.2) is also of U.P. Meanwhile Dinesh Sada fled
Patna High Court Cr.Misc. No.27123 of 2015 (2) dt.28-07-2015 2/2 away. She came to learn that the accused are indulged in immoral trafficking.
On behalf of the petitioners it has been submitted that the petitioners are in custody since 10/02/2015 and charge sheet has been submitted in this case. The petitioners have got no criminal antecedent. Further from Annexure 2 series it appears that the matter has been settled and the victim has been married to petitioner no.1.
On behalf of the State, it has been submitted that the matter has been settled between the parties. Considering the facts aforesaid, let above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Saharsa in Sour Bazar (Pastpar Police Camp) P.S.Case No. 26/2015.
