JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 366(A)/34 of the Indian Penal Code.

The victim has stated in her statement recorded under Section 164 of the Cr.P.C. that she was taken away to Goa by co-accused, Saddam and Guddu where Saddam established physical relation with her and subsequently, she returned along with Saddam who got down at Dildar Nagar Station whereas she got down from train at Buxar Station and contacted the coaccused, Guddu, who sent two persons and after that aforesaid

Patna High Court Cr.Misc. No.16814 of 2016 (2) dt.28-04-2016 2/2 persons took her to Banaras where they sold her to Manauwar. The victim has been recovered from the house of Manauwar and it is only stated that it was petitioner who sold her to Manauwar. Moreover, co-accused, Manauwar Khan has already been granted privilege of bail by this court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Nawanagar P.S. Case No. 236 of 2015.
