1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of regular bail, arises out of Masaurhi Police Station Case No. 37 of 2020, disclosing offences under Section 20/22 of the NDPS Act.
3. As per the FIR, 106 Kgs of ganja has been recovered from the husk room of the petitioner.
4. Learned counsel for the petitioner submits that petitioner is in custody since 20.01.2020 and this is fourth attempt of the petitioner for grant of bail. While rejecting the bail application of the petitioner vide order dated 02.02.2024, this Court had given liberty to the petitioner to renew his prayer for bail after seven months if the trial is not concluded. Patna High Court CR. MISC. No.4677 of 2025(3) dt.07-03-2025 2/3 has not been concluded and the custody period of the petitioner is more than five years. This Court vide its order dated 30.01.2025 called for a report regarding the status of the trial and in pursuance thereof, learned Additional Sessions Judge-II, Patna, furnished the report stating that charge sheet witnesses have been examined and the record is fixed for certification of forensic report. The court has given the expected time for conclusion of the trial within six months.
5. Regards being had to the submissions made by the parties and taking into consideration the long period of custody of more than five years of the petitioner and the fact that the petitioner is having no criminal antecedent, accordingly, I am inclined to grant regular bail to the petitioner.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount, each to the satisfaction of learned Additional Sessions Judge-II, Patna, in connection to the Masaurhi Police Station Case No. 37 of 2020.
8. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part
Patna High Court CR. MISC. No.4677 of 2025(3) dt.07-03-2025 3/3 to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
