JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-02-2022 Heard Mr. Vikram Deo Singh, the learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with K. Nagar (Maranga) P.S. Case No. 199 of 2020, dated 01.07.2020, instituted for the offences under Sections 363 and 364(A) of the Indian Penal Code. Even though the victim in her statement under
Patna High Court CR. MISC. No.16315 of 2021(3) dt.08-02-2022 2/2 Section 164 Cr.P.C. has stated that she went with the petitioner and married him of her own volition but considering the fact that she is only 17 years of age, which is not a marriageable age of a girl, I am not inclined to grant anticipatory bail to the petitioner.
The prayer for grant of anticipatory bail to the petitioner is, accordingly, rejected.
However, if he surrenders before the Court below and seeks bail, the Court below shall pass orders in accordance with law after taking into account the aforenoted grounds, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
The application stands dismissed.
