The petitioners are languishing in custody since 17.02.2016 in connection with Dumariya P.S. Case No. 01 of 2015 for the offences instituted under Sections 458, 341, 323, 324 and 307/34 of the IPC.
The prosecution story, in brief, is that four unknown persons entered in the house of the informant, two of them over powered the informant and gagged his mouth and two others made inflicted knife blow in the stomach of son of the informant and on hue and cry when the villagers assembled, they fled away. It has been submitted on behalf of the petitioners that the
Patna High Court Cr.Misc. No.18236 of 2016 (3) dt.02-09-2016 2/2 petitioners are in custody since 17.02.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioners. They have got no criminal antecedent. The main allegation is against Rajesh Yadav. He is not named in the F.I.R. The other co-accused has been granted bail vide Cr. Misc. No. 40358 of 2015. On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sherghati, Gaya, in connection with Dumariya P.S. Case No. 01 of 2015.
