The petitioner, who was posted as A.S.I. at the relevant time, has approached this Court for extending the privilege of bail in the event of his arrest or surrender in Beur P.S. Case No.52/2017 registered for the offence under Section 384 of the Indian Penal Code and Sections 7, 8, 13 of Prevention of Corruption Act, 1988.
It was submitted by learned counsel for the
Patna High Court Cr.Misc. No.21750 of 2017 (2) dt.01-07-2017 2/2 petitioner that on false accusation of allowing a vehicle loaded with wine to go free, the petitioner has been made accused in the case. According to learned counsel for the petitioner, only in the capacity of A.S.I., he was not in a position to do the act, which has been alleged by the informant.
Considering the nature of accusation, let the petitioner, namely, Sarwon Kumar @ Sarwan Kumar, in the event of arrest or surrender within six weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance 1st , Patna in connection with Beur Patna P.S. Case No.52 of 2017, subject to condition as laid down in Section 438(2) of the Code of Criminal Procedure. (Rakesh Kumar, J) NKS/- U T
