JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-08-2015 Heard learned counsels for the petitioners and the State. Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147,148,341,323,324,386,379,504,506,307 of the Indian Penal Code.

It is alleged that for none fulfilment of extortion demand Petitioner no. 1 assaulted on the head of the informant's son Manish Kumar with iron road. Petitioner no. 2 assaulted on the head of Shashi Kumar with road with intention to kill. Thereafter, the informant paid Rs. 2000/- to accused to save their life.

Patna High Court Cr.Misc. No.31304 of 2015 (2) dt.04-08-2015 2/2 Petitioners no. 1 and 4 assaulted his son with brickbats on chest and Petitioner no. 3 snatched one mobile.

It is submitted on behalf of the petitioners that injuries of the informant side have been found simple in nature. The injury report has been brought on record as Annexure 3 series. The occurrence took place on 28.01.2015 but the FIR was lodged on 01.02.2015. The petitioners have no criminal antecedent. Considering the delayed lodging of FIR and nature of injuries caused, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Cheriya Bariyarpur P.S. Case No. 13 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Prakash/- U T
