Mrs.Gulnar Begum ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-07-2020 Heard learned counsel for the petitioners and State. The petitioners are apprehending arrest in connection with Pakribarawan P.S. Case No. 311 of 2019 for the offence under Sections 341, 323, 325, 308, 379/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that there is no allegation of any assault against the petitioners. The allegation of assault is against Gola Yadav and not against the petitioners. He further submits that allegation of snatching Rs.5,000/- is against Bajo Yadav and snatching of Gold ear ring is against Gola Yadav. Allegation against petitioner no.1 is that he was armed with Iron rod and except that there is no allegation of assault.

No.5593 of 2020(3) dt.01-07-2020 2/2 Considering the aforesaid, the petitioners named above, in the event of arrest or surrender before the court below within one month from today, are directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Nawada in connection with Pakribarawan P.S. Case No. 311 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure with the condition that the petitioner nos. 2 and 3 on release will render their services as volunteer for a period of one month in dedicated Covid Hospital. They are required to report to the District Nodal Officer in the concerned region, who shall utilize their services in this pandemic.
