JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-02-2019 The petitioner apprehends his arrest in connection with Fatuha P.S.Case No. 617 of 2018 registered under Sections 307, 324 and 326/34 of the Indian penal Code and 27 of the Arms Act.

Allegation against the petitioner is of firing on the son of the informant causing injury and he was referred to Sadar Hospital Fatuha from where to N.M.C.H., Patna. Submission of learned counsel for the petitioner is that there is land dispute between the parties which will appear from the FIR itself and furthermore, injury is not mentioned. Heard learned APP also as well as learned counsel appearing on behalf of the informant who has opposed the prayer for anticipatory bail stating that there is direct allegation against the petitioner of firing causing injury on thigh. No.4158 of 2019(3) dt.04-02-2019 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to him rather he should surrender within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order, if possible, on the same day.
