JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-02-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Sangrampur P.S. Case No. 161 of 2019 registered for the offences punishable under Sections 448 and 354 of the Indian Penal Code.

The accusation against the petitioner is that he having entered into the house of informant caught the hand of informant's sister with mala fide intention.

However, learned counsel for the petitioner submits that the petitioner was mercilessly assaulted by the informant and his associates on the alleged date of occurrence and to save their skin, the informant lodged this false case against the petitioner.

Patna High Court CR. MISC. No.3243 of 2020(2) dt.28-02-2020 2/2 Learned counsel drew my attention towards Annexure-2 to the petition to fortify his above stated contentions.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let above named petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Munger in Sangrampur P.S. Case No. 161 of 2019 subject to condition as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) N.K/- U T
