The petitioner has preferred the instant application for grant of regular bail in a case registered under sections 30(a), 35, 36 and 41 of the Bihar Prohibition and Excise Act, 2016. As per allegations in the F.I.R., 808 liters of liquor was recovered from the vehicle in which the petitioner was travelling.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the possession of the petitioner. He has no concern with the vehicle in question or the seized liquor. Co-accused Aslam has been enlarged on bail. The petitioner is in custody since 2.1.2021. He has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the petitioner not having any criminal antecedent and being in custody for more than 7 months, the Court directs the petitioner to be enlarged on bail in connection with Special Case no. 4 of 2021 (arising out of Kochadhaman P.S. Case no. 2 of 2021) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-cum-Special Judge, Excise, Kisanganj.
