====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-02-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code.

3. According to F.I.R., co-accused Prince Tanti kidnapped minor grand-daughter of the informant for the purpose of marriage. This petitioner is alleged to have assisted co-accused Prince Tanti in the alleged offence.

4. Learned counsel for the petitioner submits that petitioner is unfortunate father of co-accused Prince Tanti and he has been made accused in this case merely because he is related to Prince Tanti. As a matter of fact, there was love affair between the victim and co-accused Prince Tanti and they have solemnized marriage and are living together as husband and

Patna High Court CR. MISC. No.4553 of 2025(2) dt.24-02-2025 2/2 wife. Victim is major and she left the house on her own accord. Specific accusation of kidnapping the victim is against coaccused Prince Tanti. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering nature of accusation and other facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Amdabad P. S. Case No. 79 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
