JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-01-2015 All the above said petitions arise out of Ishakchak P.S. Patna High Court Cr.Misc. No.25697 of 2014 (3) dt.13-01-2015 2/2 off by this common order.
Heard learned counsels for the petitioners and learned counsel, appearing for the State.
It is alleged that petitioners were caught with looted articles just after the occurrence of loot, for which, Kotwali P.S. Case No. 32 of 2014 was registered.
The contention on behalf of the petitioners is that the informant claimed about the recovery of mobile phones and some cash but uptill now, prosecution could not succeed to establish that the recovered mobile sets belonged to the informant of Kotwali P.S. Case No. 32 of 2014 and so far as recovery of cash is concerned; the same is not abnormal.
Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioners, named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Ishakchak P.S. Case No. 07 of 2014 to the satisfaction of Chief Judicial Magistrate, Bhagalpur. (Hemant Kumar Srivastava, J) A.K.V./- U T
