JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 27-07-2016 The instant application under Section 389(2) of the Code of Criminal Procedure has been filed by the appellant for setting the order dated 11.12.2015 passed by the learned 2nd Additional Sessions Judge, Muzaffarpur in Cr. Appeal No. 96 of 2015 arising out of Trial No. 299 of 2015 corresponding to DRI Case No. 01 MSRU/2014 whereby the prayer for suspension of sentence and grant of bail of the appellant has been rejected by the appellate court during pendency of the appeal in question. At the outset, it has been submitted by the learned counsel appearing for the Directorate of Revenue Intelligence
Patna High Court CR. APP (SJ) No.289 of 2016 (2) dt.27-07-2016 2 / 2 that the matter has finally been heard by the appellate court on 08.04.2016 and on the same day Cr. Appeal No. 96 of 2015 preferred by the appellant has already been dismissed by the appellate court.
Regard being had to the submissions made by Mr. Devendra Kumar, learned counsel for the Directorate of Revenue Intelligence, the instant application is dismissed as infructuous.
