The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 366 and 366(A) of the Indian Penal Code pending in the learned court below.

As per the prosecution case, petitioner is said to have abducted the daughter of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that there is no eye witness in the present case only on suspicion the petitioner has been made accused in his case. He submits that the daughter of the informant is a married girl and she is a major not minor. He

Patna High Court CR. MISC. No.5816 of 2023(2) dt.10-04-2023 2/2 further submits that petitioner has got no criminal antecedent as stated in para-3 of the bail application.

Per contra, learned APP for the State vehemently opposing the bail application and submitted that the from perusal of the impugned order it is clear that process under Section 83 of the Cr.P.C. has been issued against the petitioner and the victim girl is still traceless. Hence, he does not deserve anticipatory bail.

Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail in connection with Bhabua (Sonham) P.S. Case No. 552 of 2014. Accordingly, his prayer for anticipatory bail is hereby rejected. (Anjani Kumar Sharan, J) ajay/- U T
