The petitioner is languishing in custody since 21.03.2015 in a case registered for the offences punishable under Sections 436/34 of the Indian Penal Code.

It is alleged that the accused persons put their hutment on fire as a result fire spread to the house of the informant also.

It is submitted by learned counsel for the petitioner that the petitioner is own brother of the informant and there is a counter version of the occurrence as the wife of the petitioner filed Amdabad P.S. Case No. 36 of 2015 levelling accusation under Sections 341, 323, 406, 420, 436 and 504 of the

Patna High Court Cr.Misc. No.26916 of 2015 (2) dt.28-07-2015 2/2 Indian Penal Code. Accusation of omnibus and general and investigation has already concluded.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Amdabad P.S.
