Petitioner is accused in connection with Dholbajja P.S. Case No. 01 of 2016 registered under Sections 25(1-B)A and 26 of the Arms Act.

The accusation is of recovery of country made pistol and three live cartridges from the possession of the petitioner.

Learned counsel appearing on behalf of the petitioner submits that petitioner has no criminal antecedent and is in custody since 02.01.2016, while petitioner is accused in Dholbajja P.S. Case No. 51 of 2013 registered under section 302/34 of the I.P.C. in which, he is on bail and in that case, the petitioner was

Patna High Court Cr.Misc. No.17929 of 2016 (2) dt.03-05-2016 2/2 not named in the F.I.R. rather his name has come in course of investigation. It is further submitted that charge sheet has already been submitted in this case.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of J.M., 1st Class, Naugachia, District Bhagalpur in connection with Dholbajja P.S. Case No. 01 of 2016.
