The petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 342, 323, 324, 307, 354B, 379, 506 and 504 of the Indian Penal Code.

Petitioner along with other accused persons are said to have dragged the informant from his shop on filing petition by the informant before the BDO, Goraul and the petitioner is said to have assaulted below the left eye of the informant by means of dagger.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. There is case and counter case between the parties. Though the

No.4505 of 2019(2) dt.30-01-2019 2/2 petitioner is said to have assaulted the informant below his left eye by means of dagger, but the doctor has found the injury simple in nature caused by hard and blunt substance. Petitioner happens to be student of I.A. and his examination is scheduled from 06.02.2019. Petitioner has no criminal antecedent. He has been languishing inc custody since 03.12.2018. Co-accused Arvind Rai and Sonelal Rai have been enlarged on bail by different co-ordinate benches of this court.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali in connection with Goraul P.S. Case No. 324 of 2017.
