JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report, particularly, in the circumstance when the informant claims himself to be an eye witness of the alleged occurrence. Moreover, the name of petitioner came in this case in confessional statement of co-accused Sanjay Barnwal and except the aforesaid material as well as some criminal antecedent, there appears to be nothing against the petitioner, who is languishing in jail custody since 24.11.2015 and investigation against the petitioner has already been completed.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with

Patna High Court Cr.Misc. No.18164 of 2016 (2) dt.02-05-2016 2/2 two sureties of the like amount each to the satisfaction of learned Sessions Judge, Jamui in connection with Session trial no. 488 of 2012 arising out of Sono ( Charka Pathar) P.S.Case No. 66 of 2007.
