The petitioner seeks bail in a case for the offences punishable under sections 153 and 147 of the Railway Act. The prosecution story, in brief, is that on getting information that a power tiller is dashed with up train no.12142 the informant police officer rushed to the place of occurrence and seized broken parts of power tiller and case is registered against the driver.
On behalf of the petitioner it has been submitted that the petitioner is in custody since 4.12.2014. Charge sheet has been submitted in the case. The petitioner has got no criminal antecedent. The alleged occurrence is said to have taken place due
Patna High Court Cr.Misc. No.26760 of 2015 (2) dt.28-07-2015 2/2 to an accident. There was no bonafide intention on the part of the petitioner to commit any offence.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
In the facts and circumstances as stated above, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Railway Ara, Bhojpur in DNR RPF Case no. 1124 of 2014.
