The petitioner apprehend his arrest in connection with Banmankhi P.S. Case No. 276 of 2020 registered under Sections 341, 323, 324 and 307/34 of the I.P.C.
Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. Both the parties are agnates. Further he submits that petitioner has no criminal antecedent.
Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that on perusal of first information report, it would appear that there is direct allegation of assault against the petitioner at the head of
Patna High Court CR. MISC. No.15693 of 2021(2) dt.20-12-2021 2/2 son of the informant by means of farsa. Hence, the petitioner does not deserve to be enlarged on bail.
Having considered the facts and circumstances of the case and nature of the allegation, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner is rejected.
