Petitioner happens to be brother of the husband of the deceased and is languishing in jail custody since 12.3.2015 in a case registered under section 304B and other minor sections of the Indian Penal Code and section 3/ 4 of the D.P. Act.

It would appear from perusal of the first information report itself that deceased was subjected to cruelty on account of illicit relation of her husband as well as so-called illegal demand which is not specific against the petitioner.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Naugachia in Bihpur P.S. Case no. 260/2014. shahid (Hemant Kumar Srivastava,J) U T
