JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 413, 414, 420/34 of the Indian Penal Code.
Petitioner was caught by the police with stolen motorcycle and the associate of the petitioner managed to escape from there.
Contention on behalf of the petitioner is that the aforesaid motorcycle was being driven by co-accused, Sanjeev Kumar and as a matter of fact, the said motorcycle belongs to coaccused, Sanjeev Kumar. It is further contended that confessional statement of petitioner was recorded by the police under coercion
Patna High Court Cr.Misc. No.18887 of 2016 (2) dt.04-05-2016 2/2 and on the basis of aforesaid confessional statement, petitioner has been remanded in some cases. Moreover, petitioner is in jail custody since 30.10.2015 and the investigation against him has already been completed.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Kiran Chaturvedi, learned Judicial Magistrate 1st Class, Patna in connection with Patrakar Nagar P.S.
