JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code.

Petitioner is in jail custody since 22.02.2016 and the only allegation against him is that he laid down the informant on earth and sat on her chest and furthermore, pressed her neck and also snatched her ornaments.

Contention on behalf of the petitioner is that the petitioner and informant are next door neighbour and as a matter of fact, the present case has been brought by the informant with

Patna High Court Cr.Misc. No.18098 of 2016 (2) dt.02-05-2016 2/2 exaggerated story on account of previous enmity. Moreover, petitioner does not have any criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Durgawati P.S. Case No. 55 of 2016.
