JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-03-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 366-A/34 of the Indian Penal Code.

Earlier the bail prayer of the petitioner was rejected by a co-ordinate Bench of this court vide order dated 10.05.2018 passed in Cr. Misc. No. 29209 of 2018 but petitioner is in jail custody since 31.01.2018 and victim has not supported the prosecution case in her statement recorded under Section 164 of the Cr.P.C. as well as before the court in course of trial rather in both the statements she claimed that she was never kidnapped by the petitioner.

Case No. 01 of 2018.
