The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The prosecution case in nutshell is that informant's sister was married to co-accused Dinesh Ram in the year 2020 and they were blessed with a female child out of the wedlock. It is further alleged that on 9th of January, 2022, informant received information

Patna High Court CR. MISC. No.6274 of 2023(2) dt.11-04-2023 2/3 that his sister has died. Later, he came to know that petitioner along with other co-accused persons have killed his sister by pressing his neck.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. Petitioner is mother-in-law of the deceased and she has no concern with the mess and business of deceased as well as her husband. She lived separately from them. There is an inordinate delay of about five months in lodging the F.I.R. Moreover, the petitioner is languishing in judicial custody since 26.11.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody,

The above named petitioner is directed to be enlarged on bail in connection with Palanwa P.S. Case No. 120 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Raxaul, East Champaran, Motihari.
