JUSTICE SUDHIR SINGH ORAL ORDER 27-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner seeks regular bail in a case registered for the offences punishable under sections 379 and 411 of the Indian Penal Code.
It is alleged that the motor cycle of the informant bearing No. BR-21F-4603 was stolen away from in front of Fauzi Hotel where the brother of the informant had gone to take meal. On search the motor cycle was not found and the informant suspected that some unknown persons has stolen away his motor cycle.
On behalf of the petitioner it is submitted that the
Patna High Court Cr.Misc. No.26714 of 2015 (2) dt.27-07-2015 petitioner is in custody since 17.04.2015. Charge-sheet has been submitted in the case. The petitioner is not named in the F.I.R. The name of the petitioner has come on the basis of the confessional statement of co-accused. The other accused in the present case has also been enlarged on bail. It is further submitted that the petitioner may be released on bail after completion of six months in custody from 17.04.2015.
On behalf of the State, it is submitted that the name of the petitioner has come in course of investigation and the stolen motor cycle is said to have been recovered from the house of the petitioner.
Considering the facts aforesaid, let the petitioner above named, be enlarged on bail after completion of six months in custody from 17.04.2015, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Deep Nagar P.S. Case no. 229 of 2014.
