JUSTICE SUDHIR SINGH ORAL ORDER 09-06-2015 The petitioner is languishing in custody since 05.02.2015 in connection with Runnisaidpur P.S. Case No. 61 of 2015 for the offences instituted under Sections 420, 467, 468 and 471 of the Indian Penal Code.
Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that the petitioner and others have committed forgery in the School Admission Register of Middle School, Batrauli, Runnisaidpur of the accused Saroj Rai, who is involved in Sitamarhi P.S. Case No.01 of 2015 under Sections 302/34, 120B and 212 of the Indian Penal Code. The Investigating Officer has seized that Register of D.S.E, Sitamarhi Transfer Certificate, Rajkiya Madhya Vidyalay, Batrauli Post Mahindwara, District Sitamarhi of cover page 1 to 7 and 8 plain
Patna High Court Cr.Misc. No.16098 of 2015 (2) dt.09-06-2015 2/3 half cutting page 31 to 63 in two Fard in page nos.12 to 13, the name of accused Saraoj Kumar, son of Baleshwar Pd. Yadav, village Batrauli, Runnisaidpur in serial no.6 of the Admission Register in which there is cutting and written "03.04.2011", the date of birth in bracket in which there is signature of Usha Devi. The date of birth of Saroj Kumar is mentioned as "15.03.1994" and in other Bihar Shiksha Pariyojana Parishad Household Survey from 03.08.15 to 06.08.15, the date of birth of accused Saroj Rai is mentioned as "07.06.1994" in which this petitioner has signed as a teacher. As such, in presence of two independent witnesses, seizure list was prepared.
It has been submitted on behalf of the petitioner that the petitioner is a Headmaster in the Middle School and the allegation against him is that he had made certain manipulations in the Admission Register which is contrary to the transfer certificate issued by him. Further it has been submitted that the petitioner had made no manipulation in the Admission Register and if there is any manipulation in the same, that is prior to his joining as Headmaster in the said School. Further it is submitted that the petitioner has got no criminal antecedent and he is in custody since 05.02.2015.
On behalf of the State it has been submitted that there is
Patna High Court Cr.Misc. No.16098 of 2015 (2) dt.09-06-2015 3/3 direct allegation against the petitioner for making certain manipulations in the Admission Register.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No.61 of 2015.
