JUSTICE CHAKRADHARI SHARAN SINGH ORAL JUDGMENT & ORDER Date: 12-07-2017 The petitioner is said to have cleared Joint Engineering Entrance (Mains) Examination, 2017 and has been offered/going to be offered admission to National Institute of Technology (hereinafter referred to as the

Patna High Court CWJC No.9196 of 2017 dt.12-07-2017 2/3 "NIT"), Patna. He had secured 9.6 CGPA in Class-Xth Examination. The petitioner has passed the qualifying XIIth Examination, held by the Bihar School Examination Board (hereinafter referred to as the "Board"), with 57% of marks. He has applied for scrutiny of his answer-sheets before the Board within time, which is pending.

2. The difficulty, which the petitioner is facing, is that 60% marks, in Class-XIIth, is the minimum eligibility criteria for admission to the said technical courses. Since he does not have 60% of marks, he cannot be allowed admission to NIT or other technical institutions of the same standard.

3. Learned counsel, appearing on behalf of the petitioner, has submitted that counselling for admission to NIT is still going on.

4. Considering the urgency of the matter, I direct the Board to take a final decision on the petitioner's application for scrutiny of his answer-sheets by 18th day of this month.

5. Before parting with the present order, I cannot loose site of the fact that there have been complaints regarding appointment of less qualified teachers as examiners to evaluate the answer-sheets. The Court expects that while deciding the petitioner's case, on the

6. With the aforesaid observation, this application stands disposed of.
