2. The petitioner seeks regular bail in connection with Dhangai P.S. Case No. 78 of 2023 registered for the offence under Section 363 and 366(A) IPC.

3. It is alleged that the petitioner abducted the minor daughter of the informant with intent to marriy her.

4. Learned counsel for the petitioner submits that the petitioner is innocent, committed no offence and has falsely been implicated in the present case. He further submits that the petitioner is in custody since 3.11.2023.

5. However, learned APP for the State vehemently opposed the prayer for regular bail.

6. Heard both the parties, perused the first information report, impugned order dated 22.,12.2023 passed by learned 6th Additional Sessions Judge-cum- Special Judge POCSO Act, Bhojpur at Ara. The petitioner has no criminal antecedent. Charge sheet has already been submitted.The girl and the petitioner were known to each other and wanted to marry and for that purpose the daughter of the informant on her own sweet will eloped and the petitioner and his family members handed her over to the informant and his family.

7. Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail after framing of charge on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 6th Additional Sessions Judge-cum- Special Judge POCSO Act, Bhojpur at Ara in connection with Dhangai P.S. Case No. 78 of 2023.
