JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 20.3.2015 in a case registered for the offences punishable under Sections 379/411 of the Indian Penal Code.

The petitioner was found running away after taking the motorcycle of the informant from the hospital premises. It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled. The FIR was registered on 10.3.2015 but it reached to the court of the learned CJM on 13.3.2015. Delayed reaching of the FIR to the learned court below suggests that the FIR has been registered by antedating.

Patna High Court Cr.Misc. No.26572 of 2015 (2) dt.27-07-201 2/2 Considering the delayed transmission of the FIR and that the investigation has already concluded, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Muzaffarpur in connection with Ahiyapur P.S. Case No. 212 of 2015.

The learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner defaults on three consecutive occasions.
