Petitioner is said to have demanded extortion money and took Rs. 5000/- from the informant.

Submission on behalf of the petitioner is that there was land dispute between the parties and the present case is nothing but is only the result of the aforesaid land dispute. Moreover, according to the written report of the informant itself, the petitioner and unknown persons were empty hands at the time of alleged occurrence and they were not carrying any weapons.
