The petitioner prays for transfer of Matrimonial Case No. 103 of 2013 (Kundan Kumar V. Usha Kumari) from the Court of learned Principal Judge, Family Court, Muzaffarpur to the Court of Principal Judge, Family Court, East Champaran, Motihari where she is residing in the house of her father so as to enable her to pursue the matter in East Champaran, Motihari. Notices were also issued to the opposite party No. 2 which were validly served but he has failed to appear before this Court.

Considering the history of torture met to the petitioner by opposite party No. 2 and the difficulty being occasioned by her in conducting the same at Muzaffarpur, it is advisable and in the

Patna High Court MJC No.1818 of 2017 (4) dt.24-01-2018 2/2 interest of justice that the Matrimonial Case No. 103 of 2013 (Kundan Kumar V. Usha Kumari) be transferred from the Court of learned Principal Judge, Family Court, Muzaffarpur to the Court of Principal Judge, Family Court, East Champaran, Motihari. It is directed accordingly.

The application stands disposed of.
