JUSTICE SUDHIR SINGH ORAL ORDER 27-07-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State as well as the learned counsel for the informant.
The petitioner is in custody in a case registered under Sections 341, 324, 307, 504 and 506/34 of the Indian Penal Code.
The prosecution case, in brief, is that Gorelal Yadav (informant) has lodged a written report before the Officer-inCharge of Bariyarpur Police Station on 17.4.2015 at 3 P.M. stating therein that when he along with his family members was at his house, a quarrel took place between the children of Ajay Sah and his children. When his wife Kaushalya Devi, son Rajo Kumar, younger brother's wife Baby Devi and daughter Premshila Devi wanted to pacify the matter, accused Raunak Devi (petitioner) came with a Lota contained acid and threw the same on all of them, as a result of which his wife, son, daughter and younger brother's wife sustained acid injury on their face, chest and legs. In the meantime, accused Ajay Sah came there
Patna High Court Cr.Misc. No.26510 of 2015 (2) dt.27-07-2015 2/2 and threw the remaining acid on them.
On behalf of the petitioner, it is submitted that the petitioner is in custody since 18.4.2015 and charge sheet has been submitted in the case. The petitioner has no criminal antecedents. It is submitted that the petitioner is a lady. It is further submitted that the injuries sustained upon the informant's side are simple in nature. It is a case and counter case between the parties.
On behalf of the State and the informant, it is submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger, in connection with Bariyarpur P.S. Case No.62 of 2015.
