2. The petitioners are apprehending their arrest in connection with Barhara P.S. Case No. 87/2016 dated 14.02.2016 registered for the offences punishable u/ss 341, 323, 147, 149, 448, 354, 307, 379, 504 and 506 of the Indian Penal Code.

3. As per the prosecution case, the petitioners and the co-accused persons armed with lathi, danda, iron rod and hockey stick came to the house of the informant and started abusing and assaulting. In the meantime, the petitioners assaulted the informant on his head, causing head injury.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The petitioner No. 1 have no criminal antecedent whereas the petitioner No. 2 is accused in two other criminal cases as stated in para 3 of the bail petition. As per Para. 6 of the bail petition, the injury is simple in nature.

5. Learned A.P.P. for the State has vehemently opposed the prayer of anticipatory bail of the petitioners.

Considering the aforesaid facts and circumstances of the case, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhojpur at Ara in connection with Barhara P.S. Case No. 87/2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

7. This application stands allowed.
