JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-06-2020 The petitioner seeks bail in anticipation of his arrest in connection with Maniyari P. S. Case No. 246 of 2018 dated 12.08.2018 instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 353, 332, 427, 504 and 506 of the Indian Penal Code and Section 30 (a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

It appears from the records that 670 litres of liquor was found in the house of one Baliram Singh. During the process of recovery, approximately 200 persons collected at the place of occurrence and also

One Kameshwar Singh is said to have been arrested from the spot, who has disclosed the name of many persons including the petitioner. It has been submitted that some of the accused persons, who have been named as the miscreants who had assembled at the place of recovery, have been granted bail by different Benches of this Court, which fact has been mentioned in paragraph 11 of the bail petition.

There is no specific accusation against the petitioner and he is a person of clean antecedents. Thus, it is stated that no offence under anyone of the Sections of the Excise Act can at all be said to have been made out against the petitioner.

Taking the afore-stated facts into account, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on his
