1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Bidupur P.S. Case no. 620 of 2023 registered under section 392 of the Indian Penal Code.

3. As per the prosecution case, it is stated that three accused persons on the point of arms looted Rs. 5,38,212/- from the branch of the financial company.

4. Learned counsel for the petitioner submits that the F.I.R was registered against unknown. Referring to the order of the learned trial Court it is submitted that the name of the petitioner transpired in the confessional statement of co-accused made before police. No incriminating article has been recovered

Patna High Court CR. MISC. No.6849 of 2024(2) dt.17-02-2024 2/2 from the petitioner's possession who is in custody since 7.11.2023. The co-accused on whose confessional statement name of the petitioner transpired namely Sharvan Kumar @ Monu has been enlarged on bail vide order dated 1.2.2024 passed in B.P. no. 90 of 2024 by the learned Additional Sessions Judge-XII, Vaishali at Hajipur.

5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R, grant of bail to the co-accused on whose confessional statement the name of the petitioner transpired, no incriminating article having been recovered from the petitioner's possession, his being in custody since 7.11.2023 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Bidupur P.S. Case no. 620 of 2023, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur.
