The petitioner seeks bail in Pandarak P.S. Case No.12 of 2015 registered under Sections 379/411/34 of the Indian Penal Code and 25 (1-B)A,26,35 of the Arms Act. The prosecution case, in brief, is that on getting information, the police party apprehended two persons including the petitioner. On search, one loaded country made pistol along with four live cartridges are said to have been recovered. It has been submitted on behalf of the petitioner that as far as the Section under Arms Act is concerned, the same is not attracted against the petitioner as there has been no recovery of arms from the conscious possession of the petitioner. Patna High Court Cr.Misc. No.16255 of 2015 (2) dt.10-06-2015 further submitted that as per the F.I.R. six pieces of iron angles are said to have been found in the possession of the petitioner. Further it has been submitted that the petitioner has got no criminal antecedent and he is in jail since 4.2.2015.
On behalf of the State, it is submitted that the petitioner is named in the first information report. Considering the aforesaid facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M., Barh in Pandarak P.S. Case No. 12 of 2015.
